Description
McDONOUGH, Chief Justice. This action was originally begun as an action in unlawful detainer but plaintiffs -- respondents here -- waived that portion of the complaint praying damages and sought merely to quiet title in themselves to a portion of a lot, of which they are the record owners and upon which a canyon cabin of defendant -- appellant here -- has stood since 1934. The lower court held that despite the fact that a fence built in 1923, under the direction of plaintiffs predecessor in interest, was regarded by defendant as representing the true boundary, the doctrine of boundary of acquiescence does not apply in this case and entered judgment for plaintiffs requiring defendant to remove her cabin from plaintiffs property. From this judgment defendant appeals.
